Wisconsin and the federal Fair Labor Standards Act (FLSA) require employers to pay most employees "time and a half," or 1 and 1/2 times their regular rate, for all hours worked in excess of 40 per week.

Certain employees are "exempt" from overtime laws. An employee whose primary job duty is "professional, administrative, or executive" is not entitled to overtime pay. 

 

Employers sometimes "misclassify" their employees as exempt to avoid 

paying overtime. But it is the nature of the employee's work that determines whether he or she is entitled to overtime - not the label that the employer assigns.
